UAE / July 7, 2022 Stricter quota requirements for foreign workers and higher quota share for local employees Since the quota of foreign employees in the UAE is very high, the Ministry of Human Resources and Emiratization (MOHRE) is trying to increase the number of Emiratis in the labor market. On the one hand, the quota requirements are made more difficult, and on the other hand, quotas of the number of Emirati employees per company, differentiated by size, are set. For the employment of foreign workers, the MOHRE now has a list of 172 industries that count as priority for the issuance of a quota. The following industries are worth mentioning for this purpose: Military equipment manufacturing, banking services, insurance services, health services, oil and gas extraction, etc. Furthermore, foreign employees may not exceed 5 to 10% of the total staff if the company was registered before April 15, 2022. For all enterprises registered later, only 3 quotas may be issued unless they are operating in the high-priority industries. MOHRE has decided that companies with more than 50 employees must have at least 2% Emirati employees by the beginning of next year. If a company fails to meet this target, a monthly fine of AED 6,000 (approx. CHF 1,600) will be imposed per Emirati who is not hired. The future goal is for Emirati employees to make up 6% of a company. VAE / 7. Juli 2022 Strengere Anforderungen an der Kontingentserteilung für ausländische Arbeitnehmer sowie höhere Quoten für einheimische Mitarbeiter Angesichts der Tatsache, dass der Anteil ausländischer Mitarbeiter in den Vereinigten Arabischen Emiraten sehr hoch ausfällt, bemüht sich das Ministerium für Human Resources und Emiratisierung (MOHRE) um den Anstieg der Anzahl von Emiratis auf dem Arbeitsmarkt. Einerseits werden die Anforderungen zur Kontingentserteilung erschwert, andererseits werden Quoten zur Anzahl der Emiratis pro Unternehmen nach Grösse festgelegt. Für die Anstellung von ausländischen Arbeitnehmern hat nun das MOHRE eine Liste von 172 Branchen, die als prioritär für die Erteilung eines Kontingents zählen, veröffentlicht. Erwähnenswert sind hierfür folgende Branchen: Herstellung von Militärausrüstung, Bankdienstleistungen, Versicherungsdienstleistungen, Gesundheitsdienstleistungen, Öl- und Gasförderung, etc. Des Weiteren dürfen ausländische Mitarbeiter nicht mehr als 5 bis 10 % des gesamten Personals ausmachen, wenn das Unternehmen vor dem 15. April 2022 registriert wurde. Für alle später eingetragene Unternehmen dürfen nur 3 Kontingente erteilt werden, ausser sie sind in den hoch priorisierten Branchen tätig. MOHRE hat zudem entschieden, dass Unternehmen mit mehr als 50 Mitarbeitern mindestens 2% Emirati- Mitarbeiter bis Anfangs nächsten Jahres aufweisen müssen. Falls ein Unternehmen dieses Ziel nicht erreicht, wird eine monatliche Geldstrafe von AED 6’000 (ca. CHF 1’600) pro Emirati, der nicht eingestellt wird, fällig. Das zukünftige Ziel ist, dass die Emirati-Mitarbeiter 6% eines Unternehmens ausmachen. 3 convinus.com
