August 11, 2022 Global Mobility: Remote Work - With the HR Checklist on the Way to Comprehensive Compliance Years ago, it was hardly imaginable that "remote work" has become an integral part of everyday working life. Employees enjoy nowadays new freedoms to combine remote work with an extended stay abroad and companies can position themselves as attractive employers. But how do HR managers deal with international remote work and the challenges it brings? Remote work abroad brings a lot of challenges for HR so that the benefit does not turn into a liability risk for the employer. Our HR checklist provides an overview about the most important aspects: 1. Is a work permit required for the work abroad? 2. What are the reporting and registration requirements for the employer abroad? 3. Are all social security certificates available (keywords: A1, Certificate of Coverage)? 4. Will there be a tax liability triggered abroad? 5. Is there a permanent establishment risk due to the employee's work abroad? 6. Are the mandatory provisions of foreign labor law complied with (keywords: working hours, rest times, health protection)? 7. Is data protection guaranteed? 8. Do special regulations on remuneration apply to the country (keywords: minimum wages, special allowances)? 9. Are employees adequately covered by health and accident insurance? 10. Do existing labor contracts need to be adapted? 11. What are the payroll implications of working abroad, if any? 12. .... The more HR managers immerse themselves in the topic of international remote work, the more they become aware of the compliance risks. Therefore, the checklist could certainly be extended by a few more points. However, Rome was not built in a day either. It is, therefore, important to first be aware of the compliance risks related to remote work abroad and to minimize these risks step by step with the help of competent sparring partners. 6 convinus.com

August 2022 Global Mobility: Remote Work – Mit der HR-Checkliste auf dem Weg zur umfassenden Compliance Vor Jahren war es kaum vorstellbar, dass „Remote Work“ heute aus dem Arbeitsalltag kaum mehr wegzudenken ist. Mitarbeiter geniessen neue Freiheiten, um Remote Work mit einem verlängerten Auslandsaufenthalt zu verbinden und Unternehmen können sich als attraktive Arbeitgeber positionieren. Doch wie geht es den Personalverantwortlichen mit Remote Work und den damit verbunden Herausforderungen? Gerade bei Remote Work mit Auslandsbezug sind eine Vielzahl von Punkten zu beachten, damit aus dem Benefit kein Haftungsrisiko für den Arbeitgeber wird. Unsere HR-Checkliste hilft hier weiter: 1. Wird eine Arbeitsbewilligung für die Tätigkeit im Ausland benötigt? 2. Welche Meldepflichten gibt es für den Arbeitgeber im Ausland? 3. Liegen alle Sozialversicherungsbescheinigungen vor (Stichworte: A1, Certificate of Coverage)? 4. Wird eine Steuerpflicht im Ausland ausgelöst? 5. Besteht ein Betriebsstättenrisiko aufgrund der Auslandstätigkeit des Mitarbeiters? 6. Werden die zwingenden Vorschriften des ausländischen Arbeitsrechts eingehalten (Stichworte: Arbeitszeiten, Ruheregelungen, Gesundheitsschutz)? 7. Ist der Datenschutz gewährleistet? 8. Gelten für das Land besondere Verschriften zur Vergütung (Stichworte: Mindestlöhne, Zulagen)? 9. Sind die Mitarbeiter ausreichend kranken- und unfallversichert? 10. Müssen bestehende arbeitsrechtliche Regelungen angepasst werden? 11. Welche Auswirkungen hat das Arbeiten im Ausland auf die Payroll? 12. … Je mehr sich Personalverantwortliche in die Thematik „Remote Work“ vertiefen, umso mehr werden ihnen die Compliance Risiken bewusst. Daher liesse sich die Checkliste sicherlich noch um einige Punkte erweitern. Allerdings wurde auch Rom nicht an einem Tag erbaut. Es ist daher zunächst wichtig, sich der Compliance-Risiken in Bezug auf Remote Work im Ausland bewusst zu sein und diese Risiken mit der Hilfe geeigneter Sparring-Partner Schritt für Schritt zu minimieren. 7 convinus.com
