Australia / December 2, 2021 Border opening from December 15, 2021 for vaccinated visa holders and legal residents The Australian government announced the border opening for visa holders on short notice. Due to the rapid spread of the Omicron COVID-19 virus variant, this change has been delayed until December 15, 2021. Visa and valid residence permit holders who have been vaccinated with an approved vaccine will, therefore, be allowed to enter Australia without first obtaining an exemption. Recognized by the Therapeutic Goods Administration (TGA) are the following vaccines: AstraZeneca Vaxzevria AstraZeneca Covishield ·Pfizer/Biontech Comirnaty ·Moderna Spikevax ·Sinovac Coronavac ·Bharat Biotech Covaxin ·Sinopharm BBIBP-CorV (18-60 years) ·Johnson & Johnson/ Janssen-Cilag COVID Vaccine All travelers must then present a valid national or international COVID-19 certificate or a physician’s confirmation of omitted vaccination due to medical circumstances. Family members of eligible travelers can also benefit from the border opening. Only for bridging visa holders and New Zealand citizens, the entry restrictions with travel exemption continue to apply. The quarantine regulations are still valid for all travelers. Persons who have been in Lesotho, Eswatini, Namibia, Botswana, Zimbabwe, Mozambique, or Malawi in the last 14 days are not allowed to enter Australia, except for Australian citizens, legal residents, and their family members. Deutschland / 2. Dezember 2021 Verlängerung der Konsultationsvereinbarung bis zum 31. März 2022 Aufgrund der andauernden COVID-19 Pandemie wurde am 30. November 2021 die Konsultationsvereinbarung zwischen der Schweiz und Deutschland bis mindestens zum 31. März 2022 erstreckt, welche ursprünglich am 11. Juni 2020 vereinbart worden. Welchen Einfluss hat diese Vereinbarung für uns im Global Mobility-Bereich? Es geht hierbei um die Bestimmung der steuerlichen Behandlung von Erwerbseinkommen und der Bestimmung des Besteuerungsorts. Der COVID-19 Pandemie geschuldet arbeiten nach wie vor viele Arbeitnehmer von zu Hause aus. Befindet sich der Wohnsitz (bspw. Schweiz) des Arbeitnehmers im gleichen Land wie auch der übliche Arbeitsort (bspw. Schweiz), so sind in diesen Situationen steuerlich gesehen keine besonderen Regeln zu beachten. Befindet sich jedoch der Wohnsitz (bspw. Deutschland) nicht im gleichen Land wie der übliche Arbeitsort (bspw. Schweiz), dann würde das Arbeiten im Homeoffice an Stelle vom Arbeitsort möglicherweise in einer Änderung der Besteuerung resultieren. Da dies zu einigen ungewollten Herausforderungen seitens der Payroll-Abteilung sowie auch beim Arbeitnehmer führen würde, wurde diese Konsultationsvereinbarung u.a. zwischen Deutschland und der Schweiz getroffen. Die Vereinbarung beinhaltet, dass die Tatsache des Verlegens des Arbeitsortes in das «Homeoffice», während der COVID-19 Pandemie für die Besteuerung keinen Einfluss haben soll, sondern die Besteuerung des Erwerbseinkommens in der gleichen Art und Weise vorgenommen werden soll, wie der Arbeitnehmer üblicherweise gearbeitet hätte. Es wurden ähnliche Vereinbarungen ebenfalls mit Liechtenstein, Frankreich und Italien vereinbart, welche per 31. Dezember 2021 auslaufen. Höchstwahrscheinlich werden jedoch diese ebenfalls noch verlängert. Germany / December 2, 2021 Extension of the consultation agreement until 31 March 2022 Due to the ongoing COVID-19 pandemic, on 30 November 2021 the consultation agreement between Switzerland and Germany was extended until at least 31 March 2022, which was originally agreed on 11 June 2020. What impact does this agreement have for us in the Global Mobility sector? It concerns the determination of the tax treatment of employment income and the determination of the place of taxation. Due to the COVID-19 pandemic, many employees still work from home. If the employee's place of residence (e.g. Switzerland) is in the same country as the usual place of work (e.g. Switzerland), there are no special rules to be observed for tax purposes in these situations. However, if the residence (e.g. Germany) is not in the same country as the usual place of work (e.g. Switzerland), then working in the home office instead of the place of work would possibly result in a change in taxation. As this would lead to some unwanted challenges on the part of the payroll department as well as on the part of the employee, this consultation agreement was reached between Germany and Switzerland, among others. The agreement states that the fact of moving the place of work to the "home office" during the COVID-19 pandemic should have no impact on taxation, but that the taxation of the employment income should be done in the same way as the employee would normally have worked. Similar agreements have also been reached with Liechtenstein, France and Italy, which expire on 31 December 2021. However, it is highly likely that these will also be extended. 5 convinus.com
