CONVINUS Global Mobility Insights - Sommer / Summer 2024 Teleworking from Spain Author: Ana Garicano Solé, Partner | Managing Director, Sagardoy Legal & Expat, S.L.P The Spanish government has introduced a Digital Nomad Visa under the "Start-ups Law" of 2023, aimed at attracting foreign remote workers to Spain. This visa targets third-country nationals, excluding EU, EEA, and Swiss nationals and their accompanying who do not require a permit to telework in Spain. Key Features of the Digital Nomad Visa & Permit: 1. Residency and Nationality: Valid for up to one year for the visa and up to three years for the permit, with renewal options. Grants residence status, contributing towards eligibility for long-term residence permits and Spanish nationality. 2. Employment Conditions: Allows work only for employers and clients outside Spain. Freelancers can work for Spanish clients up to 20% of their work volume. 3. Family Inclusion: Dependents, including spouses, minor children, children of legal age and relatives financially dependent, can also obtain permits, allowing them to work in Spain. Eligibility Requirements: General Requirements: Must not be in Spain illegally. Must be over eighteen, with no criminal record in Spain or previous countries of residence for the past five years. Must have sufficient financial resources, at least 200% of the Spanish national minimum wage (around EUR 1’134), with additional funds for dependents. Must have valid health insurance. Specific Requirements for Remote Workers: Must be a qualified professional (graduate or postgraduate) or have at least three years of equivalent professional experience. 45
